Terms of Services
These terms of service determine your access and usage for our Platform. The service provided may be hosted by applications or other websites either owned, operated independently but connected with The Greater Mind Centre through various third-party vendors who provide the hardware, networking, storage, hardware and other related technology required to run and maintain the Platform.
By accessing or using our Platform or website, you are entering into this Agreement. It’s important to read this Agreement carefully before using the Platform or service. If you do not acknowledge, accept and agree to be bound to any term of this Agreement, do not use or access the Platform or service. If you do not agree to these Terms of Service (including the Privacy Policy) we may not be in a position to provide to you the Services which you are seeking to receive.
If you are under the age of sixteen (16) years of age, unfortunately The Greater Mind Centre cannot provide services to you. Please do not use the platform or book appointment with any practitioners if this is the case. By using and accessing our online service, you consent that you are over the age of sixteen (16).
Disclaimer
The Greater Mind Centre is not a medical Service Provider, but a Platform that refers you with third-party vendors or Service Providers.
Being part of the Platform, practitioners or Service Providers are required to have relevant accreditations, experience and necessary qualifications. Including but not limited to professional certification based on relevant state legislation, qualifications in their field (for eg. specialist service they may provide), proven qualifications or certification by registered professional board following practical training, examinations, education, and any other requirements relevant for their accreditation.
The Greater Mind Centre Service providers are independent practitioners or contractors, and not our employees, agents or representatives. Our Platform is a referral to the Service Provider and not the service itself, the Service Provider takes responsibility in relation to the service received by the Client. If you feel the Services provided isn’t matching your expectations, you may change to a different Service Provider.
As part of using our Platform, you acknowledge, accept and agree that these services may not be the appropriate solution for your needs and/or may not be a complete substitute for a face-to-face examination or other care and treatment solutions available through other providers. Our Platform is not a substitute for medical or emergency services. Service Providers are given the options of using templates and content created by The Greater Mind Centre, or content with The Greater Mind Centre logo. Applicability of the template content may not reflect the individual needs of the Service Provider, and usage of content and template is at the discretion of the Service Provider.
The Platform
By accessing or using this Platform you acknowledge, confirm and legally consent, or have a parent or legal guardians consent, that you are entering into this contract with The Greater Mind Centre, and that you are affirmatively indicating you are able to agree to this legally binding Agreement.
You acknowledge, accept and agree that all information provided by you on this Platform is accurate, truthful and current. For the duration of accessing this Platform, as well as entering this Agreement, you will ensure that your information is maintained and updated so it is accurate and current.
By accessing or using the Platform, you acknowledge, accept and agree that you are responsible for confidentiality of any security information related to your account.
If any unauthorised use of your account or security information related to your account is in breach, that you agree to notify The Greater Mind Centre immediately.
In the case that another individual who isn’t the sole owner or primary Client using or accessing the Platform, you acknowledge, accept and agree to indemnify the Platform and The Greater Mind Centre against of any damages or loss as a result of another individual using your account, this applies to you having prior knowledge or not if the other individual had consent to using your account.
By accessing and using our Platform, you acknowledge, accept and agree that you will not use another individual’s account under any circumstance. You further acknowledge and agree that your usage of the Platform is for personal use and must not be used on by another individual, company or organisation of any kind.
By using our Platform, you agree and consent to be bound by all applicable local, state, national or international laws or ruling. You also agree not to do anything that would violate any ethical codes or regulations in relation with the use of this Platform, company or its Service Providers.
You acknowledge, accept and agree that you will not make any efforts or attempt to interrupt, disorder, breach or access, including but not limited to; any systems, hosting services, Service Provider systems, technology infrastructure, networks or any of the Platforms owned by The Greater Mind Centre or affiliate/integrated systems, Platforms, hosting services, Service Provider systems, technology infrastructure, networks or any other Platforms
As part of accessing and using our Platform, you acknowledge, accept and agree that you will not use or transmit any information on the Platform for;
Email, marketing or promotional purposes of any means
Software or code that is malicious in nature,
Harassing, unlawful, privacy occupying, damaging, offensive content or violates a third party or damages intellectual property harmful content
Any information or content that causes criminal action or breaks the law
You also agree not to do anything that would violate any ethical codes or regulations in relation with the use of this Platform, company or its Service Providers.
The Greater Mind Centre reserves the right to restrict or terminate your service based on ethical standards or clinical advice/governance that may be impacted if you are seeing another practitioner or Service Provider outside of our Platform.
You acknowledge, accept and agree that any payment methods or details provided for transactions made with The Greater Mind Centre are fully authorised for use, and all payments details provided are accurate and correct for the duration of using and accessing our Platform and services.
Indemnification
You will indemnify us, defend us, and hold us harmless from and against any and all claims, losses, causes of action, demands, liabilities, costs or expenses (including, but not limited to, litigation and reasonable attorneys’ fees and expenses) arising out of or relating to any of the following:
your access to or use of the website;
any actions made with your account or Account Access whether by you or by someone else;
your violation of any of the provisions of this Agreement;
non-payment for any of the Services (including any Services) which were provided through video conferencing, phone or through the website;
your violation of any third-party right, including, without limitation, any intellectual property right, publicity, confidentiality, property or privacy right. This clause shall not merge upon expiration or termination of this Agreement.
You acknowledge, accept and agree to indemnify us and keep us indemnified the website and the Company against any indirect, incidental, consequential, special, punitive or exemplary damages. You are aware that Service Providers are given the option to use templates, forms, and content created by The Greater Mind Centre. Content is not individually customised for the Service Provider, and usage of any content created by The Greater Mind Centre is at their discretion. Individual Service Providers may have unique clauses that is not included in the template created by The Greater Mind Centre. Templates created by The Greater Mind Centre does not cover the Service Providers who choose to use The Greater Mind Centre templates (e.g., consent form, confidentiality form, intake form, assessments, privacy policy, terms of use, referral forms and other content with The Greater Mind Centre logo etc).
Modifications or Disruptions to the Platform
The Platform we provide may be subject to change, altercations, suspension or discontinuation in future circumstances to which you acknowledge, accept and agree that you or any other users accessing the Platform or service may be impacted. The Greater Mind Centre takes no liability for any losses, compensation or damages caused by any of the unforeseen circumstances mentioned above.
Notices
For the duration of time, you use our Platform or access our service, The Greater Mind Centre may communicate with you via email or SMS (text messages) messages to provide notices to your nominated information provided on sign-up in the Platform. Such notices and communications/messages will be considered as having been given on the date they were sent or received, respectively.
Billing
Cancellation Policy
We know how important your time is, so we would appreciate at least 48 hours’ notice if you need to cancel or reschedule an appointment. Scheduled appointments can be in high demand and will give us the chance to transfer your cancelled appointment to another person who needs support. We understand sometimes unexpected things happen that are unplanned. In most cases, and with enough notice, we will Endeavor to respond as quickly and as fairly as possible based on the extenuating circumstances.
Any late fees or refunds for cancelled appointments will be processed within 30 days following the event, this will be processed to your nominated bank account upon registration of our Platform. For any Session paid for in advance, you will receive the refund minus the late fees in the same time period in your nominated bank account.
Clients will receive a full refund for a cancellation under the following circumstances:
Clients cancel Session(s) at least 48 hours prior to the Session booking.
The Greater Mind Centre either cancels, reschedules, delays or modifies your Session or the Service Providers at our discretion, we reserve the right to these events due to unavailability of Service Providers or extenuating circumstances.
Please note that cancellation policies may differ depending on the individual service providers listed on our platform. The cancellation policy listed on our platform is generic which service providers are given the option to adopt into their cancellation policy at their discretion. By using our service, you agree that cancellation policy may differ, and direct contact with the service provider is necessary.
How to Cancel
To cancel your appointment or reschedule, you will contact your service provider directly.
Late Fees
Any cancellations made between 24 – 48 hours prior to the Session; a 50% payment will be processed for unpaid bookings.
Any cancellation given less than 24 hours prior to the booked Session; 100% session fee payment is processed for unpaid bookings.
If the Client doesn’t show up (“no show”) to the booked appointment without any notice, a full payment is processed, and no refunds will be applied. Please be aware that Medicare rebates are not applicable for unattended appointments.
Cancellation fees are not eligible for Medicare rebates.
Late fee and cancellation policy may differ depending on your service provider, and at their discretion.
Late Appointments
Booking confirmations and email or SMS reminders will be sent to Clients ahead of appointments. The Client will be sent reminder messages by text message and/or email in advance of their appointment.
If a Client is late for a confirmed Session or appointment, the Service provider (practitioner) will wait 30 mins before considering the appointment forfeited by the Client. In these cases, the cancellation policy applies, the Client will be deemed a “no show” and full payment will be processed without any refund.
If the Client attends the appointment within the 15mins from Session confirmation time the appointment will not be extended for attending late, Service Providers may consider extending the Session under their own discretion.
By accessing and using our Platform, you acknowledge, accept and agree to indemnify The Greater Mind Centre and all its Service providers against any claims, lawsuits, actions, liabilities, expenses, losses, costs that are directly or indirectly related to any cancellations made by you under these Terms of Service.
Pricing of Consultations & Billing Policy
All services on the Platform are subject to pricing changes and schedules reasonably determined by The Greater Mind Centre. We have the right, from time-to-time in accordance with our internal management procedures, to reasonably set and amend these fees chargeable against your account. These changes will be informed by costs associated with running and maintaining the company and/or Platform. Changes in costs will not be applied retrospectively.
The Platform will take payment for the services provided to you on our Platform from your nominated payment method upon sign-up or user/Client registration for your first appointment. For any follow up appointments, the platform will take payment following your session. We will save your payment details on your initial appointment bookings. For future sessions, we will process your payment on the same card used to pay for your initial appointment either pre-pay future session prior to your appointment, or after.
By providing your payment information or credit card details to the Platform, you are confirming that it is correct, up-to-date and authorized for use. You further confirm that any Payment information or credit card details provided in the future to the Platform will be correct, up-to-date and authorised for use.
Refunds
Your cancelled appointments will be handled in accordance with our Cancellation/Late Payment Policy. The decision to grant or refuse refunds of the costs of any services provided by the Service Provider at The Greater Mind Centre, will be made at the sole discretion of the Service Provider.
Government Rebates
The independent Service Provider may process any eligible Medicare claims on your behalf, however, this may differ depending on the Service Provider. The Greater Mind Centre does not process any claims on behalf of Service Providers.
The Medicare rebate for General psychology or Clinical Psychology services is only available through a valid referral from your GP. Please be aware the counselling or psychotherapy services are not eligible for rebates. Please refer to the medicare website for all information on medicare rebates and eligibility requirements.
The Greater Mind Centre makes no warranties or guarantees that the rebate will be successful, on-time or correct. You acknowledge, accept and confirm that by agreeing to this Terms of Use you are hereby indemnifying The Greater Mind Centre against all claims, loss, damages, injury or objections.
Third Party Content
The Platform may contain Third-party content (“Third Party Content”) which might include links to other websites or advertisements which may or may not be related to our services. We take no responsibility for the creation and administration of any such third-party content.
Warranties and Liabilities
By accessing or using our Platform, you acknowledge, accept and agree that we are not liable for any damages or personal injury caused by the Services of the Platform and hold us harmless from any causes of action or claim of any nature resulting from any Services provided on our Platform, including but not limited to the advice, act, opinion, information, recommendations, suggestions and/or service of any Service Provider and/or any other content or information hosted or displayed on the Platform or website.
By accessing or using our Platform, you acknowledge, accept and agree that the website is a service provided by the Company and all associated directors and operators provide absolutely no warranties (express or implied) including but not limited to non-infringement, security, fitness, merchantability, for a particular purpose or accuracy. The use of the Platform is at your own risk.
Copyright
The information on this Platform was produced by The Greater Mind Centre to guide, provide insight and inform anyone accessing the Platform. It is important for you to know that we cannot guarantee the accuracy of all aspects within it and cannot replace clinical or medical advice, decision or determination. Every care has been taken to produce this publication, but there are no guarantees on the accuracy of the information or what may change overtime.
The information in this Platform produced is not intended to be a substitute for medical advice. The Greater Mind Centre, its employees, contractors or Service Providers will accept no liability for any injury, loss or damage incurred resulting from dependance on information on the Platform. Any reproduction of this material must acknowledge The Greater Mind Centre as the source of selected passage(s), extract(s), or other information or material reproduced. For reproduction or publication beyond that permitted by the Copyright Act 1968 (Cth), permission should be sought in writing.
Important information about our Agreement
By accessing or using our service, you consent to have this contract interpreted in accordance with applicable Australian and global laws.
The acknowledge, accept and agree that by using this Platform that the exclusive venue for any action or proceeding arising out of relating to this Agreement, regardless of opinion, and/or common law principles; will be in Australia’s Court Of Law. You are consenting to the jurisdiction of these courts mentioned and waiving any objection or chance for an objection.
This Agreement is solely an entire Agreement between you and The Greater Mind Centre. You may not rely upon any promises or representations by us except as set forth in this Agreement. By using or accessing our Platform, you acknowledge, accept and agree that any future changes or modification to this Agreement will be effective upon posting which will happen from time-to-time. You further acknowledge, accept and agree that by accessing our Platform and using our service, that you are bound to any changes or modifications to this Agreement after the changes have been posted. If you do not agree with any changes to Agreement, you must terminate access or usage of the Platform or service.
We may freely transfer or assign this Agreement or any of its obligations hereunder. The paragraph headings in this Agreement are solely for the sake of convenience and will not be applied in the interpretation of this Agreement. If any provision of this Agreement is held by a court of competent jurisdiction to be illegal, invalid, unenforceable, or otherwise contrary to law, that provision shall be severed from the rest of the Agreement and the remaining provisions of this Agreement will remain in full force and effect.

Privacy Policy
At The Greater Mind Centre we treat your privacy very seriously. This Privacy Policy applies to all personal information collected by The Greater Mind Centre via the website located at www.thegreatermind.com.au. All our Service Providers are bound by the privacy policies, rules and guidelines of their relevant industry association or applicable under Australian laws and legislation. This privacy policy is developed to ensure our compliance with State Privacy Laws (Health records and information Privacy Act 2002 NSW) and National Privacy Law and Standards.
The Privacy Policy does not apply to the collection and use of certain employment-related information for contractors and/or employees of The Greater Mind Centre. The Privacy Policy is part of our Terms of Service. The terms in the Privacy Policy (such as, but not limited to, “we”, “our”, “us”, “Platform”, “Website” and “Service Provider”) have the same meaning as in our Terms of Service document. When you use our Platform, you accept and agree to both the Terms of Service and to the Privacy Policy. If you do not agree to be bound to any term of this Agreement or consent to this Privacy Policy, you must not use or access the Platform.
Collection of information
The kind of personal information that we collect from you will depend on how you use the Platform or the service provided to you. This information is held in a secure database. The personal information which we collect and hold about you may include:
Personally identifying information (such as your First and Last name, date of birth, gender, Medicare/Health Care/Pensioner card number, email, phone number/s)
Background information in relation to the service you wish to receive from us
The name of and contact details of your Registered Medical Professionals or Practitioners including Psychologists, Counsellors, Psychotherapists, General Practitioners or Psychiatrists)
Health information provided by you or on your behalf by other Registered Medical practitioners (such as referrals, discharge summaries, medical history, reports, and other communications)
Clinical or Case notes made by your Service provider for your therapy Sessions
Communications to your other health practitioners (such as letters to the referring medical practitioner)
Reports prepared for you or on your behalf by your Service Provider at The Greater Mind Centre
We also collect cookies from your computer which enable us to tell when you use the website and also to help customize and improve your Platform experience. Cookies enhance the Platform’s performance and are used for third-party tracking.
By using our website or Platform, you have the option to consent to the receipt of direct marketing material such as promotional email or SMS. We will only use your personal identification information (such as name, email address or mobile numbers) for this purpose if we have collected information direct from you and you have consented to receive direct marketing or promotional material from The Greater Mind Centre
All employees, contractors and owners of The Greater Mind Centre who may or may not collect or process information as part of this Agreement are subject to privacy laws and obligations, and all employees, contractors and owners of The Greater Mind Centre are trained professionals and is aware of proper handling of personal information as part of their qualification, accreditation, and professional registry body.
All our Service Providers are bound by the privacy policies, rules and guidelines of their relevant industry association or applicable under Australian laws and legislation. This is further stipulated in every Service Provider contractor Agreement entered into by The Greater Mind Centre in respect to handling your personal information.
How We Use This Information
The personal information you or your parent or legal guardian provided to us is collected and used to process and manage the services provided to you by our Service Providers.
For the duration of time you are accessing our Platform, The Greater Mind Centre may be required to share your confidential information with, or otherwise request confidential information from, third parties including Registered Medical Professionals or Practitioners including Psychologists, Counsellors, Psychotherapists, General Practitioners or Psychiatrists) to which are also bound to confidentiality obligations.
Your personal and confidential information will only be disclosed in the following circumstances by the Service Provider:
as consented by you or by your legal guardian via written or verbal consent, we may:
Provide a written report to another agency or professional for eg. GP, Lawyer or other Medical practitioner or specialist
Discuss the information collected with a relative, carer or employer
as required as part of the external party providing funding for the psychological services we provide to you (such as Medicare, Health Insurer)
if we identify an imminent threat of harm to yourself or another person we may decide, without obligation to do so, to report that information
as required by Australian law or otherwise and cannot be excluded by your wishes, for example in the case of valid issued subpoena
By agreeing to the Term of Use in relation to The Greater Mind Centre Privacy policy, you acknowledge and authorize us to make the disclosures referred to above.
The Greater Mind Centre will take all reasonable steps to maintain the confidentiality of your personal information, by accessing or using our Platform, you acknowledge, accept and agree that we are not liable for any damages or personal injury caused by the inadvertent disclosure of your personal information and hold us harmless from any causes of action or claim of any nature resulting from such disclosure.
Service Providers Retaining Information
All The Greater Mind Centre Service providers are independent practitioners/contractors and are not employed by us. Service providers are all registered members in professional organizations that set best practices for information management and data security whilst providing your service.
Your Service Provider will collect and gather additional information for the duration of Sessions you have together. Your Service Provider will often make notes about your Session. This information is utilised to provide a comprehensive assessment to provide the best possible service to you.
Your Service Provider is responsible to ensure that this confidential information is securely held according to the confidentiality policies specified by their governing organisation, and by Australian Law. All our Service Providers are bound by the privacy policies, rules and guidelines of their relevant industry association or applicable under Australian laws and legislation. Service Providers using The Greater Mind Centre platform agrees to comply with all relevant Privacy Acts and policies.
Access and/or Correction to Personal Information
Australian Privacy Principle 12 permits you to obtain access to the personal information we hold about you in certain circumstances, and Australian Privacy Principle 13 allows you to correct inaccurate personal information subject to certain exceptions. If you would like to obtain such access, please feel free to contact us as set out below.

Definitions
Agreement means the Client’s acceptance of these Terms of Service.
Client means the person requesting and engaging in services provided by its Service provider (contractors, employees) by the The Greater Mind Centre platform.
Platform means any online Platform or internet website through which the services are provided to the Client being comprised within the domain www.unboxedpride.com.au or as may be changed or updated from time to time.
The Greater Mind Centre means the owner of all intellectual property and services provided on the website and Platform.
The Greater Mind Centre means the name of the website and incorporates the owners and operators of the website and Platform
Service Providers means Registered Medical Professionals or Practitioners including but not limited to Counsellors, Psychologists (Clinical and General), General Practitioners, mental health workers, mental health practitioners, Social Workers, Psychotherapists, and other professional mental health care providers providing Services to Clients via either video conferencing, phone, through the Platform or in-person.
Session means any occurrence of an appointment or booking scheduled with a Service Provider booked by the Client or Therapist on our Platform
Third Party Consent means consent given to any Third Parties by the Client for the use of Third-Party Consent associated with the services under this Website.
The terms “we”, “us”, “our” or similar are used in this Agreement, they refer to any company that owns and operates the website (the “Company”).
